This Privacy Policy is made by NSQ Tech Private Limited incorporated in India and having its office at No.2 Jayaram Street, B4, First Floor Jain Shore Crest Thiruvanmiyur, Chennai, Tamil Nadu - 600041 (including its affiliates) which operates, maintains, and controls this Platform (hereinafter referred as “We”/ “us” / “our”).

We respect and recognise the importance of maintaining your privacy. We value your privacy and appreciate your trust in us. This Privacy Policy describes how we treat the personal information collected on or using this website https://www.mploychek.com/ and any other page that links to this Privacy Policy (together referred to as the “Platform”).

Unless otherwise defined in this Privacy Policy, capitalized terms used in this Privacy Policy have the same meanings as in our Terms of Service.

This Privacy Policy applies to all persons who visit the Platform and/or provide their data to be processed in the Platform. If you do not agree to the terms of this Privacy Policy, please do not provide us with any information and do not visit or use the Platform.

The above listed items include information you provide directly to us through your use of the Platform or information we collect about you from third party sources such as the sources provided by you as a part of the information you give us directly or any other government authorised sources.

3. How we use your information?

The data we collect and process through the Platform can be classified into two:

  1. Data we collect and process for our own purposes.
  2. Data we collect and process on behalf of our customers using the Platform (i.e, Employers).

Data collected and Processed for our own purposes:

This includes the information we collect from you directly (such as account information) or from your devices (such as IP addresses). We may use the information we collect from you for the following purposes:

  1. For creation, identification, and authentication of your user account; Sending OTP for authentication during sign-up, sign-in, password recovery or account recovery.
  2. To send Transactional Messages. We might send you emails or SMS about the status of the transactions you make in the Platform or which are made in relation to your account.
  3. For marketing purposes: We might send you information about special services. We might also tell you about new features or products. For example, if you show interest in any of our services/webinars, we may enroll you in our newsletter.
  4. For improving our products and services, including to customize your experience with us and displaying content based upon your preferences.
  5. To contact you for confirmation of a query put on our website or for other promotional purposes and to respond to your requests or questions, to confirm your registration.
  6. To look at site trends and customer interests. We may use your information to make our website and products better. We may combine information we get from you with information about you we get from third parties.
  7. For security purposes. We may use information to protect our company, our customers, or our websites.
  8. For identification and authentication purposes, when you visit the Website and/or log in to your account.

Data collected and processed on behalf of our customers using the Platform (i.e, Employers).

Please note that in respect of information we collect on behalf of our customers, we act only as Data Processors(as such term may be defined in data protection laws). We process such data only in accordance with the instructions of the Data Controller/Data Fiduciary that has engaged us for such processing. We exercise no control over such data and do not determine the means and purposes for processing such information. You may have to additionally have to look at the Privacy Notice of such Controller/Fiduciary in order to understand how they may process your data.

Data stored in Blockchain

In order to facilitate the expedient verification processes, your background information such as your address, educational qualification, previous employment details along with the results of the verification done through the Platform, are stored in a tamper-proof, decentralized ledger by way of using blockchain technology. This data can be accessed by other prospective employers in future upon your consent in order to automate the verification process.

4. Where we store your information?

Your data may be collected, stored, retained or processed anywhere and not necessarily within the county in which we are located and you agree that you have no objection for the same. It may also be processed by staff outside the country in which you are based, who work for us or for one of our suppliers. We will not transfer the data to a country if the laws in India prohibit such transfers. These countries that we transfer your data to may not provide the same level of protection for Personal Data as within your country of residence. By submitting your personal data, you agree to this transfer, storing or processing. We will take reasonable steps to provide that your data is treated securely and in accordance with this privacy policy.

The basic user information we collect about you, including your name, email address, contact number, authentication information and the Blockchain Private Key is stored by us in our AWS cloud servers. The verification information such as the verified address, social security numbers, other authorized proofs of identity such as driving license, educational qualification, previous employment details along with the supporting documents and evidences are stored in the Blockchain.

5. How long do we retain your information?

We retain the information collected for a period reasonably required for business purposes or for a period as required under any law.

Data stored in our servers shall be retained for a period of 7 years.

You must understand that for the purposes of facilitating verifications in future, the data in the blockchain is stored perpetually. Access of data to the employers using the Platform is however for a limited to certain period of time only based on their business purpose. User on the platform will be provided option to destroy the private key which will stop any further access to the data.

6. How we safeguard your data?

We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your information. Unfortunately, transmission of information via the internet is not always secure and we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. As mentioned above, once we receive your transmission of information, we make commercially reasonable efforts to ensure its security in our systems. However, please note we cannot guarantee the security of your information in our system and that such information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Blockchains are known for providing a high degree of encryption and security. The personal data stored in the blockchain used by the Platform is by default encrypted through a smart contract. Users can access the data only with a valid private key through smart contract which is part of MPloyChek platform. You will have the private key for your information stored in the blockchain. MployCheck or other users in the Platform, will be able to access the data only upon your authorization.

7. Cookies

A cookie is a small piece of data that a website stores on your device when you visit such website, and which is then read when you later revisit the site. Cookies are used to enable certain features such as logging in to our website, to track site usage via analytics, and to store your user settings. By accepting our use of cookies, apart from necessary cookies, you consent to our use of cookies as described under our Cookie Policy.

8. Sharing of information with third parties

Group Companies: We may share your information with our group companies, who may also use your information for the purposes set out above and also to send you emails (and other correspondence) about their products and services.

Vendors and Service Providers: We will share information with third parties who perform services on our behalf. This includes vendors that assist us to manage our business operations, transactional message processors, etc. Some vendors may be located outside of India.

Government and Public Authorities: We may preserve or disclose your information if we feel we are required to do so in order to comply with applicable law, regulation, legal process, government request, including to meet national security requirements. We may also might also share information when we are investigating potential fraud.

Business Transfers: We may share information with any successor to all or part of our business. For example, if part of our business is sold, we may give our customer list as part of that transaction.

We may, in certain cases, also be required to share your information for reasons not described in this policy. If such a requirement arises, we will take our best efforts to notify you of the same in advance, unless we are prohibited from sharing such information.

However, we suggest that you regularly check this Privacy Policy to apprise yourself of any updates. Your continued use of the Platform following the posting of changes will mean that you accept and agree to the revisions. We will set up a “last updated” date at the starting of the Policy for you to conveniently know the last date on which the Privacy Policy was modified.

Our Platform may contain links to other websites. When you click one of these links, you will connect with another website. We have no responsibility or control over any linked websites or their privacy policies or the manner in which they collect, use or disclose your personally identifiable information.

12. Information for Users outside the Indian Jurisdiction

If you are visiting our Platform from outside of India, please be aware that information we obtain from you will be processed in the said or other jurisdictions. By using the sites, you agree that any personal information which you provide will be treated in accordant with the laws of India. In furtherance, you acknowledge and consent to the international transfer and processing of your personal data as described in this Website Privacy Policy.
